1. Service Description & Beta Status
LiTofS ("Listen to your favorite song") is a QR-activated shared music queue web application. The service is currently provided as a beta release. By using the service, you acknowledge that features, functionality, system limits, and pricing are subject to change and that the service is provided on an "as-is" and "as-available" basis.
2. Role Definitions & Responsibilities
Hosts (Drivers/Venues): Any registered user who initiates a music playback session. Hosts are solely responsible for managing their playback environment, hardware, and physical space (such as vehicles or venues).
Guests (Passengers/Riders): Anyone who scans a session QR code and queues tracks. Guests are not required to register accounts. Guests must comply with acceptable use guidelines when submitting content.
3. Music Licensing Compliance (Host Responsibility)
LiTofS streams audio content from independent open catalogs (Audius and Jamendo). LiTofS does not provide public performance licensing. If you are playing music in a commercial, business, or public venue (including but not limited to restaurants, rideshare vehicles, bars, cafés, retail spaces, gyms, or hotels), you are solely responsible for obtaining any necessary public performance licenses from relevant Performing Rights Organizations (PROs) such as ASCAP, BMI, SESAC, or GMR in the United States, or local organizations in your region. You agree to indemnify and hold harmless LiTofS against any licensing claims arising from your commercial use of the service.
4. Acceptable Use Policy
When using LiTofS, hosts and guests agree not to submit, queue, or promote any content that is abusive, harassing, defamatory, vulgar, or illegal. You agree not to attempt to reverse engineer, disrupt, spam, or bypass any access limits of the application or database.
5. Disclaimer of Warranties & Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LITOFS AND ITS DEVELOPERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT SHALL LITOFS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE.
6. Termination & Suspension
We reserve the right to suspend or terminate host accounts or sessions at our sole discretion, without notice, for violation of these terms, suspected abuse, or non-payment of subscription fees.
